Si la praxéologie mérite aujourd’hui notre attention, c’est parce qu’elle permet de remonter aux origines des « théories de l’action », des sociologies de l’action ou des philosophies de l’action qui ont marqué le xxe siècle. Que veut dire, au fond, étudier l’action, en proposer ensuite une théorie, à visée soit descriptive soit normative? Dans ce qui suit, on va étudier la question en compagnie de Tadeusz Kotarbiński (1886-1981), philosophe analytique, et de Harold Garfinkel (1917-2011), sociologue hétérodoxe. Ce texte défend (...) l’idée selon laquelle parmi les conséquences les plus marquantes du travail de Garfinkel se trouve la démystification de la « théorie de l’action », et que certaines intuitions similaires sont déjà très présentes chez Kotarbiński (dont les travaux sur l’action constituent, selon Garfinkel, un « échec extrêmement important »). La praxéologie chez les deux auteurs n’est pas une discipline, mais une façon de voir la pratique étudiée comme un tout, à l’instar des recherches menées par les théoriciens de la Gestalt. La dimension athéorique de l’étude de l’action humaine proposée ici permet d’espérer qu’un jour, les phénomènes qui nous entourent vont pouvoir être étudiés pour ce qu’ils sont, et non pas pour ce qu’une théorie élégante permet d’en dire. The aim of this study is to explore the relationship between affectivity and moral experience from a phenomenological perspective. I will start by showing how in a phenomenologically oriented account emotions can be conceived as intentional evaluative feelings which play a role in both moral epistemology and the motivation of moral behaviour. I will then move to discuss a particular kind of affect, "existential feelings" (Ratcliffe in Journal of Consciousness Studies 12(8–10), 43–60, 2005, 2008), which has not been considered so (...) far in the discourse on moral and affective experience. Relying on the notion of pre-intentionality through which Ratcliffe characterizes existential feelings (Inquiry: An Interdisciplinary Journal of Philosophy 53(6), 602–626, 2010) and on some insights into the relationship between affectivity and ethics developed by De Monticelli (2003, 2006), I suggest that key to the role played by existential feelings in moral experience is that they determine the kinds of evaluations that it is possible for us to make and the range of our possibilities of action. I then illustrate and further develop this idea through a phenomenological analysis of some forms of psychopathological experience. More specifically, by considering some experiential features of depression and borderline personality disorder, I claim that, by acquiring an existential character, emotions such as guilt, feelings of isolation, anger and shame can radically alter the structure of the individual evaluative perspective, having a deep impact on both moral judgements and behaviours. Recent research has demonstrated an asymmetry between the origins and endpoints of motion events, with preferential attention given to endpoints rather than beginnings of motion in both language and memory. Two experiments explore this asymmetry further and test its implications for language production and comprehension. Experiment 1 shows that both adults and 4-year-old children detect fewer within-category changes in source than goal objects when tested for memory of motion events; furthermore, these groups produce fewer references to source than goal objects (...) when describing the same motion events. Experiment 2 asks whether the specificity of encoding source/goal relations differs in both spatial memory and the comprehension of novel spatial vocabulary. Results show that endpoint configuration changes are detected more accurately than source configuration changes by both adults and young children. Furthermore, when interpreting novel motion verbs, both age groups expect more fine-grained lexical distinctions in the domain of endpoint configurations compared to that of source configurations. These studies demonstrate that a cognitive-attentional bias in spatial representation and memory affects both the detail of linguistic encoding during the use of spatial language and the specificity of hypotheses about spatial referents that learners build during the acquisition of the spatial lexicon. Following SOX, financial restatements increased dramatically. Prior research suggests that how investors respond to restatements, particularly those involving fraud, may mitigate or exacerbate damage suffered. We extend both accounting and management research by examining the joint effects of pre-restatement managerial reputation and the announcement of managerial corrective actions in response to a restatement on nonprofessional investors’ judgments. We find that pre-restatement managerial reputation and the announcement of managerial corrective actions jointly influence investors’ managerial fraud prevention assessments, which mediate their trust (...) in management. These trust perceptions in turn affect investors’ investment and CEO retention judgments. Our results have implications for firms that are concerned with lessening the negative consequences associated with issuing a restatement. (shrink)

Background: Ethics and dignity in prehospital emergency care are important due to vulnerability and suffering. Patients can lose control of their body and encounter unfamiliar faces in an emergency situation. Objective: To describe what specialist ambulance nurse students experienced as preserved and humiliated dignity in prehospital emergency care. Research design: The study had a qualitative approach. Method: Data were collected by Flanagan’s critical incident technique. The participants were 26 specialist ambulance nurse students who described two critical incidents of preserved and (...) humiliated dignity, from prehospital emergency care. Data consist of 52 critical incidents and were analyzed with interpretive content analysis. Ethical considerations: The study followed the ethical principles in accordance with the Declaration of Helsinki. Findings: The result showed how human dignity in prehospital emergency care can be preserved by the ambulance nurse being there for the patient. The ambulance nurses meet the patient in the patient’s world and make professional decisions. The ambulance nurse respects the patient’s will and protects the patient’s body from the gaze of others. Humiliated dignity was described through the ambulance nurse abandoning the patient and by healthcare professionals failing, disrespecting, and ignoring the patient. Discussion: It is a unique situation when a nurse meets a patient face to face in a critical life or death moment. The discussion describes courage and the ethical vision to see another human. Conclusion: Dignity was preserved when the ambulance nurse showed respect and protected the patient in prehospital emergency care. The ambulance nurse students’ ethical obligation results in the courage to see when a patient’s dignity is in jeopardy of being humiliated. Humiliated dignity occurs when patients are ignored and left unprotected. This ethical dilemma affects the ambulance nurse students badly due to the fact that the morals and attitudes of ambulance nurses are reflected in their actions toward the patient. (shrink)

We discuss an epileptic incident in an undiagnosed 13-year old girl participating in a clinical study investigating the effects of transcranial direct current stimulation in healthy children and adolescents. This incident poses important research ethics questions with regard to study design, especially pertaining to screening and gaining informed consent. Potential benefits and problems of the incident also need to be considered. The ethical analysis of the case presented in this paper has been informed by an in-depth interview conducted after the (...) incident with the child and the accompanying parent. We discuss the ethical implications of the epileptic incident, the need for improving screening procedures for studies with minors and for providing more effective communication. This case also underscores the problem of undetected teenage epilepsy in neuropsychological clinical studies and the necessity of raising more awareness of this issue. Since research in tDCS is an active and expanding field, we conclude with providing some recommendation that could ensure that future research on tDCS, or other therapies and neuro-interventions where there is a risk of triggering an epileptic seizure, take into account the specifics of teenage epilepsy and the need for more thorough provision of information during the process of gaining informed consent. My aim in the paper will be to better understand what faultless disagreement could possibly consist in and what speakers disagree over when they faultlessly do so. To that end, I will first look at various examples of faultless disagreement. Since I will eventually claim that different forms of faultless disagreement can be modeled semantically on different forms of context-sensitivity I will, in a second step, discuss three different semantic accounts that all promise to successfully accommodate certain forms of context-sensitivity: (...) Indexical Contextualism, Nonindexcal Contextualism and Radical Relativism. Focussing on the controversy between Indexical and Nonindexical Contextualists the remainder of the paper will be devoted to the question which theory is best suited to handle what kind of disagreement. How do people respond to others' accidental behaviors? Reward and punishment for accidents might be depend on the actor's intentions, or instead on the unintended outcomes she brings about. Yet, existing paradigms in experimental economics do not include the possibility of accidental monetary allocations. We explore the balance of outcomes and intentions in a two-player economic game where monetary allocations are made with a "trembling hand": that is, intentions and outcomes are sometimes mismatched. Player 1 allocates $10 between herself and (...) Player 2 by rolling one of three dice. One die has a high probability of a selfish outcome, another has a high probability of a fair outcome, and the third has a high probability of a generous outcome. Based on Player 1's choice of die, Player 2 can infer her intentions. However, any of the three die can yield any of the three possible outcomes. Player 2 is given the opportunity to respond to Player 1's allocation by adding to or subtracting from Player 1's payoff. We find that Player 2's responses are influenced substantially by the accidental outcome of Player 1's roll of the die. Comparison to control conditions suggests that in contexts where the allocation is at least partially under the control of Player 1, Player 2 will punish Player 1 accountable for unintentional negative outcomes. In addition, Player 2's responses are influenced by Player 1's intention. However, Player 2 tends to modulate his responses substantially more for selfish intentions than for generous intentions. This novel economic game provides new insight into the psychological mechanisms underlying social preferences for fairness and retribution. (shrink)

There are two main ways of understanding the function of surrogate decision making in a legal context: the Best Interests Standard and the Substituted Judgment Standard. First, we will argue that the Best Interests Standard is difficult to apply to unconscious patients. Application is difficult regardless of whether they have ever been conscious. Second, we will argue that if we accept the least problematic explanation of how unconscious patients can have interests, we are also obliged to accept that the Substituted (...) Judgment Standard can be coherently applied to patients who have never been conscious at the same extent as the Best Interests Standard. We then argue that acknowledging this result is important in order to show patients respect. (shrink)

The present paper expounds the logic notation proposed by Augustus De Morgan in 1850 from within the original context of De Morgan’s account of syllogistic logic and his approach to quantification. The notational system of 1850 is shown to be a flexible tool to state inferences, to prove their validity and to derive formulæ of the respective system by ‘blind’ application of transformation rules. These pertain to the swapping of operator signs, which are of inverse ‘character’ in a two-fold sense: (...) The signs both represent inverse operations and exemplify oppositeness due to their very shapes. Thus, while De Morgan’s initial choice of symbol shapes is due to certain diagrammatic features, his notational system of 1850 leads to an account of logical operations as effected by manipulation of symbol tokens. It is concluded that as an instantiation of what De Morgan terms a ‘calculus of opposite relations’, his notation of 1850 may also be conceived of as a ‘graphicism’ affording for the working of a ‘symbolic machine’ on ‘de-semantification’. The goal of the present study was to investigate the interaction between different senses of polysemous nouns (metonymies and metaphors) and different meanings of homonyms using the method of event-related potentials (ERPs) and a priming paradigm. Participants read two-word phrases containing ambiguous words and made a sensicality judgment. Phrases with polysemes highlighted their literal sense and were preceded by primes with either the same or different – metonymic or metaphorical – sense. Similarly, phrases with homonyms were primed by phrases with (...) a consistent or inconsistent meaning of the noun. The results demonstrated that polysemous phrases with literal senses preceded by metonymic primes did not differ in ERP responses from the control condition with the same literal primes. In contrast, processing phrases with the literal sense preceded by metaphorical primes resulted in N400 and P600 effects that might reflect a very limited priming effect. The priming effect observed between metonymic and literal senses supports the idea that these senses share a single representation in the mental lexicon. In contrast, the effects observed for polysemes with metaphorical primes characterize lexical access to the word’s target sense and competition between the two word senses. The processing of homonyms preceded by the prime with an inconsistent meaning, although it did not elicit an N400 effect, was accompanied by a P600 effect as compared to the control condition with a consistent meaning of the prime. We suppose that the absence of the N400 effect may result from inhibition of the target meaning by the inconsistent prime, whereas the P600 response might reflect processes of reanalysis, activation, and integration of the target meaning. Our results provide additional evidence for the difference in processing mechanisms between metonymies and metaphors that might have separate representations in the mental lexicon, although they are more related as compared to homonyms. In dieser Arbeit wird die Frage nach der Handlungsfähigkeit künstlicher Systeme im Schnittfeld von Philosophie und KI behandelt. Eine positive Antwort auf Seiten der Philosophie hat deren anthropozentrischer Handlungsbegriff verhindert. Daher wird unterhalb des philosophischen Handlungsbegriffes der Begriff einer Quasi-Handlung entwickelt, welcher die Möglichkeit bietet, zwischen verschiedenen Kategorien des Verhaltens künstlicher Systeme zu unterscheiden. Als wesentliches Kriterium werden hierzu Unterschiede in der Flexibilität des Informationensverarbeitungsprozesses zur Differenzierung verschiedener Verhaltensklassen vorgeschlagen. Dies führt auch zu einer Auseinandersetzung mit dem Begriff der Kognition (...) und den verschiedenen Arten des Lernens. (shrink)

This article addresses Schmitt’s concept of sovereign dictatorship—a departure from the normal legal order aiming to bring about a new mode of legality—as applied to the Marxist, and then Soviet, “dictatorship of the proletariat.” Unlike Schmitt, Marx and Engels, as well as Soviet legal theorists, saw the space for law even while aiming to dispense with the legal form on the road to communism. This is best explained by Schmitt’s failure to recognize the importance of legal systems not only for (...) controlling social conflict, but also for coordination, the need for which does not disappear in extraordinary circumstances. Abstractabstract There are estimated to be five million vegetarians in the United Kingdom and another four million in the United States. There are numerous vegetarians elsewhere in the world: around fifteen million, for instance, in India. Some of these vegetarians are parents. And some of the vegetarian parents will bring up their children to be vegetarian, too. Is this a permissible course of action? Or should vegetarian parents raise omnivorous offspring? In this article, I consider three arguments that aim to (...) show that a parent should not raise a child on a vegetarian diet. None of these arguments are convincing and I know of no better ones — so I conclude that it is permissible for a parent to raise her child as a vegetarian. (shrink)

The ability to be creative is often considered a unique characteristic of conscious beings and many efforts have been directed at demonstrating a relationship between creativity and the personality construct of psychoticism. The present study sought to investigate this link explicitly by focusing on discrete facets of creative cognition, namely the originality/novelty dimension and the practicality/usefulness dimension. Based on Eysenck’s conceptualisation of psychoticism as being characterised by an overinclusive cognitive style, it was expected that higher levels of psychoticism would accompany (...) a greater degree of conceptual expansion and elevated levels of originality in creative imagery, but would be unrelated to the practicality/usefulness of an idea. These hypotheses were confirmed in 80 healthy participants who were contrasted based on their EPQ psychoticism scale scores. Our findings suggest that the link between psychoticism and creativity is based on associative thinking and broader but weak top-down activation patterns rather than on goal-related thinking. Fazekas and Overgaard () present a novel, multidimensional model that explains different ways in which conscious representations can be degraded. Moreover, the authors discuss possible mechanisms that underlie different kinds of degradation, primarily those related to attentional processing. In this letter, we argue that the proposed mechanisms are not sufficient. We propose that attentional mechanisms work differently at various processing stages; and factors that are independent of attentional ones, such as expectation, previous experience, and context, should be accounted for if (...) we are aiming to construct a comprehensive model of conscious visual perception. ABSTRACT In this survey we have investigated the experiences and attitudes of Danish physicians regarding end‐of life decisions. Most respondents have made decisions that involve hastening the death of a patient, and almost all find it acceptable to do so. Such decisions are made more often, and considered ethically more acceptable, with the informed consent of the patient than without. But both non‐resuscitation decisions, and decisions to provide pain relief in doses that will shorten the patient's life, have been made (...) and found acceptable by at least 50% of the respondents, even when there is no informed consent. Furthermore, 12% have doubled morphine dosages with fixed intervals, thus providing doses substantially higher than that necessary to control pain, without the informed consent of the patient. Two per cent have helped in assisted suicide, and 5% have administered a lethal injection at the patient's request. Respectively 37% and 34% find these last two practices ethically acceptable. Amongst those that do not find them acceptable, the most important reasons to be opposed are, the doctrine of double effect, the doctrine of doing and allowing, and the view that human life is sacred. Amongst supporters, the most important reasons mentioned are, that the patient's right to self‐determination should be respected, the view that a patient should not be forced to suffer, and the view that the patient has a right to be helped to a dignified death. In anticipation of a new edition of the Passio apostolorum Petri et Pauli, this article analyzes the recensio conducted by Lipsius for his edition of 1891. The review of the main variants highlighted by the editor reverses his thesis: they depend on innovations by reduction, not by interpolation. Such innovations could perhaps depend on early medieval liturgical use of the work. With regard to the methodology, the comparison with the Greek tradition of the work, as an external criterion of evaluation, (...) appears misleading, since it is unlikely that Greek is the original language. In this paper a case is made concerning how important levels of media technology and new interactive tex-tures affect urban landscapes. The case is based on experiences and empirical examples from a Scandinavian city in which levels of interactive infrastructures, mediated spaces, and places, are high, and in which accessibility and social inclusion traditionally have been strong components in societal and systems design. Our designerly approach discloses some of ways that the city is enacted by a new digital materiality. This (...) materiality can only bee disclosed if the relationship between the city and ICT is understood as a meaningful whole – a totality – in this text illustrated by the notions of landmarks and imprints. Based on our case we suggest that it is possible to employ an ethical dwelling reflecting the endless, active and ongo-ing responsibility for the city and its interactive textures in everyday life. Artykuł analizuje proces włączenia ustnych relacji świadków do sfery publicznej, jaką jest reportaż polifoniczny. Gatunek ten jest znany przeważnie dzięki Swietłanie Aleksijewicz, której publikacje w całości opierają się na zarejestrowanych rozmowach i wywiadach. Wysłuchanie świadków umożliwia reporterce dotarcie do innych wobec dyskursu dominującego wersji przeszłości, wydobywanie i utekstowienie których można opisać odwołując się do ludowej tradycji wspólnego śpiewu.

The article presents results of a study aimed at exploring social concepts associated with bodily ‘normativity’ and ‘passability’: the notion of normative body weight and attitude towards over- and underweight individuals. We were particularly interested in the common concepts and notions associated with normative body weight as well as possible reasons for rejection of people whose bodies do not fall within the socially shared knowledge of what the ‘right’ body is. Förintelsen är ett historiskt skeende som är närvarande i en svensk samtid och bearbetas inom kultursektorn, politiken, forsknings­ och skolvärlden av både det svenska majoritetssamhället och den judiska minoriteten. Under 2010­-talet har de överlevandes barnbarn trätt fram och kallar sig för den tredje generationens överlevande. Några ur den generationen har självmant tagit på sig ansvaret att berätta sina mor­ och farföräldrars historier i både muntlig och skriftlig form. Tillsammans formar dessa skildringar ett transmedialt berättande som innehåller mytiska strukturer, element och (...) språkbruk. Syftet med artikeln är därför att belysa detta mönster. Artikeln bygger på ett socialantropologiskt fältarbete i Stockholm som genomfördes under 2010­-talet. Observationer genomfördes på ett flertal platser i Stockholm med omnejd, och därtill gjordes intervjuer med personer från den tredje generationen. Analysen fokuserar på det transmediala berättandet, framförallt texter och radioprogram som producerats av den tredje generationen, och den struktur, de mönster och de språkliga symboler som den tredje generationen valt att centrera berättelserna kring. The development of computer sciences has transformed the way of thinking and our perception of the world. To express this new view of the world, a new language is created, which uses such notions as “virtuality”, “virtual world”, “virtual reality”. These words have already worked in our colloquial speech and our thinking. However, they are used in various contexts and have a different meaning. The paper offers some remarks on the problem of the meaning of these notions and draws some (...) consequences of their interpretation. (shrink)

The subject of this article is bibliological reflection on Umberto Eco’s novel. Its storyline is a pretext for asking the questions about the reader’s identity. Is human the sum of all the texts one has read? What is the importance of books for constructing the self? How does the printed text influence its reception, given the location of literature in the context of mass culture? Moreover, the article reflects on the role of illustrations in literature as well as on the (...) way in which illustrations function in a printed text. Furthermore, the article investigates the roles of pictures and their importance for the composition of storyline. Umberto Eco’s novel is seen here as a hypertextual book. (shrink)

The aim of this paper is to analyse the legal record on civil litigation from mid-March 2020 to mid-July 2021 and examine COVID-19 pandemic-related arguments in a sample of litigated cases heard in Polish courts, more precisely 41 cases. In an attempt to establish the number and types of court cases in which such arguments have been raised, the population of individual case records was accessed electronically from the Ordinary Courts Judgments Portal. The analysed research material consists of texts of (...) written justifications published along with rulings of courts of the first instance in the Portal, except for texts regarding criminal cases and widely understood labour cases. This paper refers to certain theoretical aspects of argument and argumentation. Then, it sheds light on the use of COVID-19 pandemic-related arguments by the parties involved in litigation—as reported by the courts in written justifications—considering, amongst others, whether those arguments were found convincing by the courts. Based on a survey of relevant cases, an attempt was made to identify categories of COVID-19 pandemic-related arguments of the parties involved in litigation, raised in their legal submissions. Also a look into the tendencies in this regard was taken to see whether any patterns emerge and it is possible to discern different trends in the analysed phenomena. The point of the analysis in this article is both descriptive and normative. (shrink)
